Legal Protection Checklist for Foreign Patients Undergoing Plastic Surgery in Colombia (2026 Edition)

A Preventive Legal Guide by Nieto Lawyers

This guide has been prepared by Nieto & Nieto Lawyers, a Colombian law firm specialized in healthcare regulation and medical liability matters involving international patients.

Before you travel. Before you sign. Before you undergo surgery.

Plastic surgery abroad is not only a medical decision, it is a legal and financial investment. This guide provides a structured checklist to minimize legal risks before, during, and after cosmetic procedures in Colombia.

Before Choosing the Clinic

Selecting the right clinic and medical team is not only a medical decision — it is also a legal risk assessment. Before committing to any cosmetic procedure in Colombia, consider the following:

1.Verify Clinic Authorization with the Health Secretariat

Ensure that the clinic or surgical center is officially authorized by the corresponding Departmental or District Health Secretariat. Authorization confirms that the facility meets minimum legal standards regarding infrastructure, hygiene, equipment, and operational protocols.

2. Confirm Surgeon Certification and Specialty Registration

Verify that the physician is properly licensed in Colombia and registered as a specialist in plastic surgery with the relevant professional authorities. Board certification and professional registration are essential indicators of formal training and legal practice status.

3. Ask About Malpractice Insurance Coverage

Confirm whether the surgeon and/or clinic maintain active medical malpractice insurance. While insurance does not eliminate medical risk, it may be decisive in ensuring financial solvency in potential liability scenarios.

4.  Request a Written Quotation and Detailed Scope of Procedure

Always request a written estimate that clearly describes what is included in the procedure (surgeon’s fees, anesthesia, facility costs, post-operative care, potential revisions). Ambiguity in pricing may later complicate contractual and liability discussions.

5. Confirm Anesthesia Provider Credentials

Anesthesia carries its own risks. Verify that the anesthesiologist is properly licensed and certified. In many cases, anesthesia-related complications generate independent liability.

Before Signing Any Document

Signing documents before surgery is not a mere formality. It defines your legal position if complications arise. Consider the following:

✔ Review the Informed Consent Carefully

Informed consent should clearly explain the procedure, risks, possible complications, alternatives, and post-operative expectations. It should not contain vague or generic language that fails to reflect your specific procedure.

If something is unclear, request clarification in writing.

✔ Avoid Clauses Waiving Future Claims

Be cautious of clauses that attempt to limit or waive liability in advance. While consent acknowledges medical risks, it does not authorize negligence. Any clause that broadly waives your right to legal action should be reviewed before signing.

✔ Do Not Sign Blank or Incomplete Documents

Never sign documents that contain blank spaces, missing information, or handwritten additions made after signature. All fields should be fully completed before signing.

✔ Request Translated Documents if Needed

If Spanish is not your first language, request a translated version or a certified explanation of the document. You must fully understand what you are signing. Misunderstood consent can later complicate legal discussions.

✔ Preserve All Advertising Promises

Save screenshots, emails, brochures, and promotional materials. If specific results were represented, those materials may later become relevant in assessing whether expectations were reasonably created.

During and Immediately After Surgery

If Complications Occur

Act strategically and calmly.

✔ Seek Independent Medical Evaluation

Obtain a second opinion from an unrelated institution. An independent medical assessment can provide objective documentation.

✔ Preserve All Evidence

Do not discard medical materials, prescriptions, correspondence, or digital communications. Evidence preservation strengthens any future legal analysis.

✔ Avoid Signing Waivers or Settlement Documents

After complications, clinics may propose corrective treatments in exchange for waivers or confidentiality agreements. Do not sign any settlement or release document without legal review.

✔ Contact Legal Counsel Before Negotiating

Early legal guidance can clarify options, deadlines, and strategy. Even if you ultimately choose negotiation, informed negotiation is always preferable to reactive decisions.

 Cross-Border Legal Options (Foreign Patients)

Even if you have already returned to your country, you may still enforce your rights in Colombia. In most cases, legal actions can be initiated and managed remotely through a Colombian attorney.

1) Power of Attorney (POA)

A Power of Attorney allows a lawyer in Colombia to represent you before courts and authorities, request medical records, submit claims, and attend proceedings on your behalf.

Depending on your location, the POA can typically be executed:

At a Colombian Consulate, or by notarization and apostille (if applicable under international rules in your country)

A properly drafted POA is often the first step to move your case forward without requiring you to travel.

Need a Power of Attorney?

Send us your city and country via WhatsApp.

Within 24 hours, we will deliver your tailored POA package, including the nearest signing option (Colombian Consulate or notarization + apostille), with clear instructions based on your location.

No travel to Colombia required. Message us on WhatsApp to get started.

2) Remote Litigation and Virtual Participation

Many proceedings in Colombia can be handled without your physical presence. When necessary, you may participate remotely through:

Virtual hearings (videoconference)

Remote witness statements or interviews

Digital submission of evidence and documents, when accepted by the relevant authority

Your attorney can manage procedural filings, deadlines, and communications in Colombia while you remain abroad.

3) Legal Actions Available (Civil, Criminal, Administrative)

Depending on the facts and evidence, cases involving complications from cosmetic surgery may involve one or more of the following avenues:

Civil claim (medical liability): seeks financial compensation for damages (e.g., medical costs, corrective procedures, lost income, moral damages).

Criminal complaint: may apply in severe negligence scenarios that potentially qualify as criminal conduct.

Administrative and disciplinary actions: may be filed before health authorities or medical ethics bodies to request investigations, inspections, and sanctions.

A legal strategy may combine these routes, depending on your objectives and the specific circumstances.

4) Statutes of Limitations (Simplified Overview)

Legal claims are subject to time limits, which may vary based on the type of action and case details. As a general, simplified reference:

Civil actions: often up to 10 years (depending on when the harm occurred or became known)

Criminal actions: often around 5 years (depending on the alleged offense)

Administrative/disciplinary complaints: may be much shorter, sometimes as little as 6 months

Because deadlines can be complex and fact-dependent, early legal review is strongly recommended.

Important note: This guide is for informational purposes and does not constitute legal advice. Each case requires individualized assessment.

Surgical Legal Due Diligence Service

At Nieto & Nieto Lawyers, we offer a preventive legal due diligence service for international patients considering cosmetic surgery in Colombia.

Before you commit to a procedure, we can:

  • Conduct a legal background review of the surgeon, including verification of civil, criminal, or disciplinary proceedings (if any).
  • Review the regulatory standing of the clinic or surgical facility.
  • Assess whether the institution has faced investigations, sanctions, or requirements from the Health Secretariat.
  • Analyze the professional and regulatory trajectory of both the surgeon and the clinic.

Based on this review, we issue a structured legal risk assessment report to help you make an informed decision before traveling or signing any document.
