What once started as a debate around the right to be forgotten and the scope of habeas data has now expanded to the urgent need to regulate AI and its impact on fundamental rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Precedent: Constitutional Court Ruling T-323 of 2024<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"580\" src=\"https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/10\/2-1-1024x580.jpg\" alt=\"\" class=\"wp-image-2429\" srcset=\"https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/10\/2-1-1024x580.jpg 1024w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/10\/2-1-300x170.jpg 300w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/10\/2-1-768x435.jpg 768w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/10\/2-1-1536x870.jpg 1536w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/10\/2-1.jpg 1920w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>In this landmark case, the Court reviewed the situation of a lower court judge who used ChatGPT to help draft a health-related decision.
