Competition authorities in other jurisdictions have also investigated Apple for similar practices:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In the European Union, the European Commission fined Apple \u20ac500 million because the company required that all in-app purchases be made exclusively through its own payment system, charging a commission. Developers were not allowed to inform users about cheaper external payment methods.<\/li>\n\n\n\n<li>In the United States, the Department of Justice (DOJ) and several state attorneys general filed an antitrust lawsuit against Apple, arguing that the company has created a monopoly in the iPhone market. The main accusation is that Apple uses different strategies to keep users \u201clocked in\u201d to its ecosystem, making it very difficult to switch to other systems or use competing services.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What is a dominant position in Colombian competition law?<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"580\" data-src=\"https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/09\/3-1024x580.jpg\" alt=\"\" class=\"wp-image-2357 lazyload\" data-srcset=\"https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/09\/3-1024x580.jpg 1024w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/09\/3-300x170.jpg 300w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/09\/3-768x435.jpg 768w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/09\/3-1536x870.jpg 1536w, https:\/\/nietolawyers.com\/en\/wp-content\/uploads\/2025\/09\/3.jpg 1920w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/580;\" \/><\/figure>\n\n\n\n<p>In Colombia, article 45 of Decree 2153 of 1992 defines dominant position as \u201cthe ability to determine, directly or indirectly, the conditions of a market.\u201d This means that a company with a dominant position can set prices, quality, production, or supply conditions without being significantly affected by competitors or consumer behavior.<\/p>\n\n\n\n<p>The SIC has explained that to determine whether a company holds a dominant position, it evaluates factors such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Market share and level of participation.<\/li>\n\n\n\n<li>The existence of entry or expansion barriers (natural or artificial).<\/li>\n\n\n\n<li>The number and strength of current competitors.<\/li>\n\n\n\n<li>Other relevant elements depending on the case.<\/li>\n<\/ul>\n\n\n\n<p>It is important to clarify that having a dominant position is not illegal in itself.
