In the crypto context, DIAN expressly states that residents obtaining income from cryptoasset activities must recognize and include that income in their Colombian income tax return under the applicable rules.

For non-residents, the analysis is different. DIAN states that a non-resident who economically exploits a cryptoasset in Colombia may be subject to Colombian income tax in connection with that activity.

This creates a critical distinction for international investors:

Where your exchange or wallet is located is not necessarily the same question as where you are tax resident or where income is considered to arise.

That is why a proper Colombian crypto tax analysis often starts with the person and the underlying transaction not the wallet.

3. Can DIAN identify crypto held in a private or self-custody wallet?

This was expressly raised in DIAN’s May 2026 official response.
